Compulsory electronic land registration when mortgaging only became the law in 1998. Most mortgage companies did use electronic registration from around 1970 but it was not compulsory at that time, therefore many land transactions took place using just the property Title Deeds. If the title deeds were ever lost then it could become very difficult to prove ownership of land or a property, especially land.

If you are the legal representative of a person who you think has lost land or property then get in touch, we may be able to help. Due to the nature of lost land or property, investigations into this type of work are not included within any of our lost asset searches. However, most of our lost asset searches are restricted to the last 30-40 years, lost land and property can go back longer however you would need to show good reason to go back beyond this period. This research cannot be carried out blindly or speculatively.

Lost Deeds

If you are the legal representative, and you know definitively that the person you represent has lost their property deeds then you must contact us early. The worst scenario would be to clear their property. Painstaking document searches of their property contents must be carried out, we do not just mean for the deeds themselves, our specialist team should be called in to clear any property from the beginning. The smallest piece of evidence, which can easily be unwittingly overlooked, can make the difference to whether the land registry accept a submission for reconstruction of the title deeds. Reconstruction of Title

If the title deeds to a property or land are lost then there is still hope. We work with specialist conveyance firms who may be able to recreate the title deeds. This is why, as mentioned above, you must not clear a person's property. Historic documentation maybe required by conveyancers in order to reconstruct any property title. If the land registry accept that the reconstruction of the title is valid then they would be happy to register the property, in effect they are reissuing the title deeds. Adverse Possession

If you have taken possession of land or property that you know was not yours then it is still possible to claim the same. There is strict criteria for this process. You cannot just break into a property and because you have lived there for six months expect to claim adverse possession. Claiming adverse possession takes many years, apart from which you would need to take steps to advise the legal owners giving them the opportunity to object. Email our team with the full facts of the matter including when you took possession of the property and what has happened since that time.
